User Agreement

I understand that this web page and all of its components, links and sub directories, hereafter referenced as the “Software”, is a copyrighted, proprietary work belonging to PanGlobal Training Systems Ltd. (“PanGlobal”) and that the Software is being distributed by PanGlobal solely as a support for its content based learning ware.

I hereby warrant that I am either: (i) a full or part-time student in the areas of learning associated with the software, and/or (ii) a faculty or staff member of a publicly funded educational institution and/or (iii) a training staff member of an organization performing its own support of staff education. PanGlobal hereby offers to me the right to possess and use the Software subject to the following terms and conditions:

  1. I will use the Software for academic purposes in connection with my studies only. I will not use the Software for any commercial, non-profit, or revenue generating business activities or purposes.
  2. I will install a copy of the Software on one device. I may reassign the Software from one device to another device, but may not use the Software on more than one device at any point in time.
  3. I will not sell, lease, assign, redistribute, share or lend the Software or charge for the use of the Software by anyone.
  4. I will not make copies of the Software for distribution and will not permit access to the Software by others.
  5. I will not reverse engineer, decompile, modify or disassemble the Software. PanGlobal retains all titles, interests, rights and intellectual property rights in and to the Software which are not explicitly granted to me under this Agreement. Any modifications made to the Software, unless expressly authorized in writing by PanGlobal, constitute a violation of this Agreement, and are the property of PanGlobal.
  6. The Software is licensed as a single product. Its component parts, if any, may not be separated for use on more than one computer unless expressly stated otherwise in the use terms.
  7. Without prejudice to any other rights, PanGlobal may terminate this Agreement if I fail to comply with the terms and conditions herein. In such event, I must destroy all copies of the Software and all of its component parts that are in my control or possession.
  8. All title and copyright in and to the Software (including but not limited to any images, photographs, animations, video, audio, music, text, and “applets” incorporated into the Software), and any copies of the Software, including back-up copies made by me, are owned by PanGlobal. The Software is protected by copyright laws and international treaty provisions.
  9. If I violate any of the terms of this Agreement PanGlobal has the right to take legal action against me.
  10. PanGlobal retains all rights to the Software which are not expressly granted to me herein.
  11. PanGlobal warrants that it has the right to grant this license to use this Software. PanGlobal does not warrant that the functions contained in the Software will meet my requirements or will operate without interruption or error. The Software subject to this agreement is provided AS IS, without warranty of any kind. ALL IMPLIED WARRANTIES INCLUDING WITHOUT LIMITATION, THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED. IN NO EVENT SHALL PANGLOBAL OR ANY OF ITS AFFILIATES, SHAREHOLDERS, GOVERNORS, DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE TO ME OR ANY OTHER PARTY FOR ANY LOSS OR DAMAGE, CONSEQUENTIAL, INDIRECT, SPECIAL, INCIDENTAL OR OTHERWISE ARISING FROM THE USE OF THE SOFTWARE.
